Dual-Capacity Disclosure
Required disclosure when Walk Thru Wealth acts as both Real Estate Agent and Mortgage Loan Originator in a single transaction.
⚠ IMPORTANT: Read this disclosure carefully before proceeding with Walk Thru Wealth in a dual-capacity arrangement. This disclosure must be signed and retained before any dual-capacity engagement begins.
1. Disclosure of Dual Licensure
Walter Oliva holds both a California Department of Real Estate (DRE) salesperson license (#02425405), operating under Broker Pactum, INC, and a Nationwide Multistate Licensing System (NMLS) mortgage loan originator license (#2659514), also sponsored by Pactum, INC.
In certain transactions, Walter Oliva may offer to act in both capacities — as your real estate agent AND as your mortgage loan originator. This is referred to as "dual-capacity" representation.
2. Potential Conflicts of Interest
Acting in a dual capacity creates potential conflicts of interest that you should understand before proceeding:
As your real estate agent, Walter Oliva's compensation is typically a commission paid from the sale proceeds, calculated as a percentage of the purchase price. Higher purchase prices generally result in higher commissions.
As your mortgage loan originator, Walter Oliva may earn origination fees or yield spread premiums based on your loan terms. Different loan products may result in different compensation.
These interests may not always align with each other or with your interests as a buyer, seller, or borrower.
3. Your Rights
You are NOT required to use Walk Thru Wealth for both services. You may:
• Use Walk Thru Wealth as your real estate agent only, and select your own lender independently.
• Use Walk Thru Wealth as your mortgage loan originator only, and select your own real estate agent independently.
• Use Walk Thru Wealth for both services after reviewing and signing this disclosure.
• Select a different real estate agent and/or different mortgage lender entirely.
4. Broker Review
This dual-capacity arrangement has been reviewed and approved by Pactum, INC, the sponsoring broker for both the real estate and mortgage activities of Walter Oliva. A copy of this disclosure will be retained in your transaction file.
